Site Terms of Use

1. Scope of These Terms

These Site Terms of Use ("Terms") govern your use of divuspark.com (the "Site"), operated by DivuSpark LLC ("DivuSpark", "we", "us").

The Site is a pre-launch informational and early-access sign-up page. The DivuSpark platform itself is not provided through this Site: no accounts are created, no content is published, and no payments are taken here.

The platform's full Terms of Service are a separate document and will be presented to you separately at registration when the platform becomes available; those terms take effect only upon your acceptance. This document does not replace them.

2. Early Access Sign-Up (Waitlist)

By leaving your email address on the Site, you may join the early-access list to receive launch notifications.

2.1 What Sign-Up Provides

Sign-up serves only to notify you when the platform becomes available.

2.2 What Sign-Up Does Not Provide

Sign-up does not create any right of access to the platform, place in a queue, priority, privilege, guarantee of an invitation, right to free use, or any commitment as to pricing or plans. We make no commitment regarding the launch date, scope, or conditions.

2.3 Accurate Email

You must provide an email address that belongs to you and that you can access. Do not submit someone else's address without their consent.

2.4 Opting Out

You may remove your registration at any time. Simply reply to any email we send you, or write to privacy@divuspark.com. Upon your request, your email address will be removed from the list and we will stop sending you messages.

2.5 Your Personal Data

3. Site Content and Intellectual Property

All content on the Site — including text, imagery, the emblem and wordmark, design, interface, animations, the mini-game featured on the Site, and source code — is owned by or licensed to DivuSpark LLC and protected by intellectual property law.

The "DivuSpark" name, logo, and related marks are trademarks of DivuSpark LLC and may not be used without our written permission.

You may view the Site for personal, non-commercial purposes. Any other reproduction, adaptation, distribution, or creation of derivative works requires our written permission.

4. Prohibited Uses

When using the Site, you agree not to:

Systematically collect data using automated means (bots, scrapers, crawlers)
Submit false, automated, or duplicate waitlist registrations
Place load on the Site or attempt attacks intended to disrupt its operation (including DDoS, injection, or unauthorized access attempts)
Attempt to circumvent security measures or exploit a vulnerability without authorization
Use the Site in violation of applicable law

If you discover a security vulnerability, we ask that you report it to legal@divuspark.com rather than exploit it.

5. Features Described on the Site

The Site promotes a platform that is under development. Features, concepts, plans, and visuals described on the Site or in our promotional materials are for informational purposes; they may change, be delayed, or be omitted from the final product. We make no guarantee as to their availability, timing, or characteristics.

6. Disclaimer of Warranties

The Site is provided "as is" and "as available". To the extent permitted by applicable law, we make no express or implied warranty that the Site will be uninterrupted, error-free, or free of vulnerabilities. We may suspend access to the Site, modify its content, or discontinue it.

7. Limitation of Liability

To the fullest extent permitted by applicable law, DivuSpark LLC shall not be liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site.

This limitation does not affect consumer rights that cannot be excluded under applicable law.

8. Third-Party Links

The Site may link to third-party sites, such as our social media accounts. We are not responsible for the content or privacy practices of those sites.

9. Changes to These Terms

We may update these Terms. The current version is always published on this page and the "Last Updated" date above is revised. Continuing to use the Site after a change means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States of America. For consumers habitually resident in Türkiye, rights granted by Turkish consumer legislation that cannot be waived by contract remain reserved.
